(Amended House Bill Number 272)

AN ACT

To amend section 2307.382 and to enact sections 9.57 and 3501.40 of the Revised Code to expand the basis of a court's exercise of personal jurisdiction to include any basis consistent with the Ohio Constitution and the United States Constitution, to prohibit a public official from ordering the closure of all places of worship in a geographic area, and to prohibit a public official from changing the time, place, or manner of conducting an election, except in certain circumstances.

Be it enacted by the General Assembly of the State of Ohio:

Section 1. That section 2307.382 be amended and sections 9.57 and 3501.40 of the Revised Code be enacted to read as follows:

Sec. 9.57. (A) Notwithstanding any contrary provision of the Revised Code, no public official shall issue an order to close all places of worship in the state or in a geographic area of the state.

(B) As used in this section:

(1) "Place of worship" means a building or grounds where activities of an organized religious group are conducted.

(2) "Public official" means any elected or appointed officer, employee, or agent of the state or any political subdivision, board, commission, bureau, or other public body established by law.

Sec. 2307.382. (A) A court may exercise personal jurisdiction over a person who acts directly or by an agent, as to a cause of action arising from the person's:

(1) Transacting any business in this state;

(2) Contracting to supply services or goods in this state;

(3) Causing tortious injury by an act or omission in this state;

(4) Causing tortious injury in this state by an act or omission outside this state if he the person regularly does or solicits business, or engages in any other persistent course of conduct, or derives substantial revenue from goods used or consumed or services rendered in this state;

(5) Causing injury in this state to any person by breach of warranty expressly or impliedly made in the sale of goods outside this state when he the person might reasonably have expected such person to use, consume, or be affected by the goods in this state, provided that he the person also regularly does or solicits business, or engages in any other persistent course of conduct, or derives substantial revenue from goods used or consumed or services rendered in this state;

(6) Causing tortious injury in this state to any person by an act outside this state committed with the purpose of injuring persons, when he the person might reasonably have expected that some person would be injured thereby in this state;

(7) Causing tortious injury to any person by a criminal act, any element of which takes place in this state, which he the person commits or in the commission of which he the person is guilty of complicity.

(8) Having an interest in, using, or possessing real property in this state;

(9) Contracting to insure any person, property, or risk located within this state at the time of contracting.

(B) For purposes of this section, a person who enters into an agreement, as a principal, with a sales representative for the solicitation of orders in this state is transacting business in this state. As used in this division, "principal" and "sales representative" have the same meanings as in section 1335.11 of the Revised Code.

(C) When In addition to a court's exercise of personal jurisdiction under division (A) of this section, a court may exercise personal jurisdiction over a person is based solely upon this section, only a cause of action arising from acts enumerated in this section may be asserted against him on any basis consistent with the Ohio Constitution and the United States Constitution .

Sec. 3501.40. Except as permitted under section 161.09 of the Revised Code, and notwithstanding any other contrary provision of the Revised Code, no public official shall cause an election to be conducted other than in the time, place, and manner prescribed by the Revised Code.

As used in this section, "public official" means any elected or appointed officer, employee, or agent of the state or any political subdivision, board, commission, bureau, or other public body established by law.

Section 2. That existing section 2307.382 of the Revised Code is hereby repealed.
