SYNOPSIS

Nonprofit agricultural membership organizations

R.C. 3901.96

Specifies that healthcare benefit coverage provided by a nonprofit agricultural membership organization, as opposed to the organization itself, is exempt from state insurance laws.

Prohibits a nonprofit agricultural membership organization from representing that the healthcare benefit coverage it provides to its members is insurance in any official written materials or verbal communications to current or prospective members and their families ("material marketing").

Requires, as a condition of the exemption, that the application for healthcare benefit coverage and any contract provided to a member be in writing and prominently state that the coverage is not insurance and is not subject to state insurance laws.

Adds references to the Physician-Health Plan Partnership Act and the law governing multiple employer welfare agreements to the list of state insurance laws from which the healthcare benefit coverage is exempted.
