SYNOPSIS

Maximum duration of treatment for incompetency

R.C. 2945.38

Prohibits a defendant from being required to undergo treatment for longer than three years, rather than five years, if the most serious offense with which the defendant is charged is one of the following:

- Aggravated murder;

- Murder;

- An offense of violence for which a sentence of death or life imprisonment may be imposed;

- Complicity for committing one of the above offenses.
