(Amended Substitute Senate Bill Number 54)
AN ACT
To amend section 122.12 and to enact sections 122.29, 122.291, 122.292, and 149.60 of the Revised Code and to amend Sections 200.30, 207.16, 207.24, 207.30, 209.10, 213.20, 221.10, 221.15, 223.10, 223.15, 237.10, 237.13, 357.05, 357.37, 371.10, 371.20, 373.10, 373.15, 379.10, 379.30, 387.10, and 387.13 of H.B. 2 of the 135th General Assembly and Sections 221.10, 297.10, and 373.20 of H.B. 33 of the 135th General Assembly to create the Ohio River Commission and the Ohio Ireland Trade Commission, to broaden the types of national or international competitions eligible for a sports site selection grant, to support state employee compensation, to reimburse county boards of elections for certain costs of the May 6, 2025, primary and special election, to support soil and water conservation districts, to support suicide prevention in schools, to modify certain appropriations for fiscal year 2025, to modify certain capital appropriations and reappropriations for the biennium ending June 30, 2026, and to make appropriations.
Be it enacted by the General Assembly of the State of Ohio:
Section 1. That section 122.12 be amended and sections 122.29, 122.291, 122.292, and 149.60 of the Revised Code be enacted to read as follows:
Sec. 122.12. As used in this section and in sections 122.121 and 122.122 of the Revised Code:
(A) "Endorsing county" means a county that contains a site selected by a site selection organization for one or more games.
(B) "Endorsing municipality" means a municipal corporation that contains a site selected by a site selection organization for one or more games.
(C) "Game support contract" means a joinder undertaking, joinder agreement, or similar contract executed by an endorsing municipality or endorsing county and a site selection organization.
(D) "Game" means a national or international competition or other event, such as a player draft or commemoration, associated with a sport, including the special olympics.
(E) "Joinder agreement" means an agreement entered into by a local organizing committee, endorsing municipality, or endorsing county, or more than one endorsing municipality or county acting collectively and a site selection organization setting out representations and assurances by each endorsing municipality or endorsing county in connection with the selection of a site in this state for the location of a game.
(F) "Joinder undertaking" means an agreement entered into by a local organizing committee, endorsing municipality, or endorsing county, or more than one endorsing municipality or county acting collectively and a site selection organization that each endorsing municipality or endorsing county will execute a joinder agreement in the event that the site selection organization selects a site in this state for a game.
(G) "Local organizing committee" means a nonprofit corporation or its successor in interest that:
(1) Has been authorized by an endorsing municipality, endorsing county, or more than one endorsing municipality or county acting collectively to pursue an application and bid on the applicant's behalf to a site selection organization for selection as the site of one or more games; or
(2) With the authorization of an endorsing municipality, endorsing county, or more than one endorsing municipality or county acting collectively, has executed an agreement with a site selection organization regarding a bid to host one or more games.
(H) "Site selection organization" means the national or international governing body of a sport that is recognized as such by the endorsing municipality, endorsing county, or local organizing committee.
(I)
"Sport" means football, auto racing, rugby, cricket, horse
racing, mixed martial arts, boxing, baseball, or any sport
competition
that
is governed
either
or both of the following:
(1)
Governed by
an international federation
and included ;
(2) Included in at least one of the following:
(a) Olympic games;
(b) Pan American games;
(c) Commonwealth games.
(J) "Qualifying costs" means the costs to fulfill the obligations of a local organizing committee, endorsing municipality, or endorsing county to a site selection organization under a game support contract, which obligations may include the payment of the following costs:
(1) Costs relating to the preparations necessary for the conduct of the game, including acquiring, renovating, or constructing facilities;
(2) Costs of conducting the game;
(3) Costs to assist the local organizing committee, endorsing municipality, or endorsing county in providing assurances required by a site selection organization sponsoring one or more games.
Sec. 122.29. (A) The Ohio river commission is created within the department of development to develop and promote economic development, marine cargo terminal operations, and travel and tourism on the Ohio river and its tributaries. The commission consists of the following members:
(1) The director of development, or the director's designee, who shall serve as chairperson of the commission;
(2) The director of transportation, or the director's designee;
(3) The director of natural resources, or the director's designee;
(4) Six members representing the general public, three of whom shall be appointed by the president of the senate and three of whom shall be appointed by the speaker of the house of representatives.
The appointed members may represent private industry associated or affiliated with marine cargo terminal operations on the Ohio river and private industry possessing experience in marine cargo terminal operations or travel and tourism on the Ohio river.
(B)(1) Each appointed member of the commission shall be a resident of this state or a designee of a business licensed or registered in this state.
(2) All members shall be reimbursed for actual expenses incurred in the performance of their duties.
(C)(1) Within sixty days after the effective date of this section, the speaker of the house of representatives and the senate president shall make initial appointments to the commission.
(2) Terms of office for appointed members shall be for four years.
(3) Vacancies shall be filled in the manner provided for original appointments.
(4) Each term shall end on the same day of the same month as did the term that it succeeds. Each appointed member shall hold office from the date of the member's appointment until the end of the term for which the member was appointed. Any member appointed to fill a vacancy before the expiration of the term for which the member's predecessor was appointed shall hold office for the remainder of that term. Any appointed member shall continue in office subsequent to the expiration date of the member's term until the member's successor takes office, or for a period of sixty days, whichever occurs first. All members are eligible for reappointment.
(D) Five members of the commission constitute a quorum. The affirmative vote of a majority of the quorum is necessary for any action taken by the commission. No vacancy in the membership of the commission impairs the rights of a quorum to exercise all the rights and perform all the duties of the commission.
(E) All members of the commission are subject to Chapter 102. of the Revised Code.
(F) The department of development may assist the commission in furtherance of the commission's purposes. The department of development and the department of transportation, upon the request of the commission, shall cooperate in the implementation of this section. The department of development shall provide meeting and office space for the commission.
(G) Expenditures by the department of development, the commission, or any other state agency for capital improvements to promote economic development, marine cargo terminal operations, and travel and tourism on the Ohio river and its tributaries are subject to the approval of the controlling board.
Sec. 122.291. (A) The Ohio river commission may do all of the following, subject to available funding through appropriations made directly by the general assembly or the controlling board to the commission:
(1) Employ an executive director who shall have appropriate experience as determined by the commission, and a secretary-treasurer and other employees that the commission considers appropriate. The commission may fix the compensation of the employees.
(2) Adopt and, from time to time, ratify, amend, and repeal bylaws necessary and proper for the regulation of its affairs and the conduct of its business and rules to implement and make effective its powers and duties;
(3) Receive, promote, support, and consider recommendations, from public or private planning organizations, and develop a master plan for Ohio river infrastructure and transportation projects;
(4) Coordinate with port authorities, private port operators, metropolitan planning organizations, regional transportation planning organizations, local development districts, Ohio river service entities, utility service providers, and agricultural, tourism, and recreational interests, regarding Ohio river infrastructure and transportation;
(5) In conjunction with applicable state agencies, coordinate with state agencies, local governments and communities, other states, and the federal government regarding Ohio river issues;
(6) Collect, track, and maintain key statistics and data regarding commerce on the Ohio river and make an annual report to the general assembly;
(7) Ensure the monitoring of federal, state, and local policies, programs, and priorities pertaining to the development and operation of marine cargo terminals and travel and tourism on the Ohio river;
(8) Prioritize policies, programs, and issues identified in the Ohio maritime strategy prepared by the department of transportation and in the department's "Economic Impact of the Ohio River Maritime Activity" study, as those or similar documents or reports are published and updated from time to time by the department;
(9) Evaluate policies, programs, programs of research, and priorities to offset the continued decline in coal production and consumption within the Ohio river basin and promote prosperity in the Appalachian region of this state;
(10) Administer development funds and seek, support, and assist the Ohio river industry in the utilization of available grants, loans, and other finance mechanisms in support of Ohio river projects;
(11) Represent the interests of this state in regional, national, and international forums pertaining to economic development, marine cargo terminals, and travel and tourism on the Ohio river and its tributaries;
(12) Coordinate, for dissemination and publication, information regarding the commission and its related activities in connection with the Ohio river;
(13) Raise funds through direct solicitation or other fundraising events alone, or with other groups, and accept gifts, grants, and bequests from individuals, corporations, foundations, governmental agencies, and public and private organizations and institutions. The funds, gifts, grants, or bequests received pursuant to this section shall be deposited to the Ohio river commission fund created in section 122.292 of the Revised Code.
(B) The commission, or the department of development, on behalf of the commission, may apply for and receive from the United States government grants in accordance with any federal law or program, for the benefit of Ohio river infrastructure, transportation, or recreation and tourism.
Sec. 122.292. (A) The Ohio river commission fund is created in the state treasury. The fund consists of all money as may be provided by law, including money received from any sale, transfer, or lease of property and money received under division (A)(13) of section 122.291 of the Revised Code.
(B) The Ohio river commission shall use money in the fund to defray the commission's administrative expenses and to carry out its purposes set forth in sections 122.29 to 122.292 of the Revised Code.
Sec. 149.60. (A) The Ohio Ireland trade commission is created. The commission shall study potential means of advancing the following:
(1) Bilateral trade and investment between Ohio and Ireland;
(2) Policy issues of mutual interest to Ohio and Ireland;
(3) Business and academic exchanges between Ohio and Ireland;
(4) Mutual economic support between Ohio and Ireland;
(5) Mutual investment in the infrastructure of Ohio and Ireland;
(6) Other issues as determined by the commission.
(B) The commission shall consist of the following members:
(1) Three members of the senate, appointed by the president of the senate, who have knowledge of, or current or past involvement in, organizations that promote Irish affairs, or have interest in the well-being of trade relations between Ohio and Ireland;
(2) Three members of the house of representatives, appointed by the speaker of the house of representatives, who have knowledge of, or current or past involvement in, organizations that promote Irish affairs, or have interest in the well-being of trade relations between Ohio and Ireland;
(3) Three members appointed by the governor, with the advice and consent of the senate, who shall include the following:
(a) One member who represents a state institution of higher education, as defined in section 3345.011 of the Revised Code;
(b) One member who represents the Ohio chamber of commerce or a successor organization that advances business interests in this state;
(c) One member who represents Irish American communities or interest in this state.
(C) Members of the commission shall be appointed not later than ninety days after the effective date of this section. Members of the commission appointed under divisions (B)(1) and (2) of this section shall serve terms of two years or for the remainder of the member's legislative term, whichever is less. Members of the commission appointed under division (B)(3) of this section shall serve terms of four years. Any vacancy on the commission shall be filled in the same manner as the original appointment.
(D) Members of the commission shall serve without compensation but may be reimbursed for expenses actually incurred in the performance of their duties, within the limits of funds available to the commission for such purposes.
(E)(1) The commission shall meet and hold hearings at the places it designates throughout the state.
(2) The commission shall elect a chairperson from among the members of the commission. The chairperson may appoint from the commission members of subcommittees and subcommittee chairpersons at the chairperson's discretion.
(3) A majority of the members of the commission constitutes a quorum for the transaction of the business of the commission.
(F) Not later than fifteen months after the effective date of this section, and annually thereafter, the commission shall issue a report of its activities during the preceding year, and any associated findings and recommendations, to the governor, the president of the senate, and the speaker of the house of representatives.
(G) The commission may raise funds through direct solicitation or other fundraising events alone, or with other groups, and accept gifts, grants, and bequests from individuals, corporations, foundations, governmental agencies, and public and private organizations and institutions. The funds, gifts, grants, or bequests received pursuant to this section shall be deposited to the Ohio Ireland trade commission fund, which is created in the state treasury. The commission shall use the fund to defray the commission's administrative expenses and to carry out its purposes set forth in this section.
Section 2. That existing section 122.12 of the Revised Code is hereby repealed.
Section 3. All items in this act are hereby appropriated as designated out of any moneys in the state treasury to the credit of the designated fund. For all operating appropriations made in Sections 4 through 8 of this act, those in the first column are for fiscal year 2024 and those in the second column are for fiscal year 2025. The operating appropriations made in Sections 4 through 8 of this act are in addition to any other operating appropriations made for these fiscal years.

BOE REIMBURSEMENT AND EDUCATION
Upon completion of the May 6, 2025, primary and special election, or as soon as possible thereafter, county boards of elections shall certify to the Secretary of State the expenses they incur for conducting the election that are eligible for reimbursement under section 3501.17 of the Revised Code.
The foregoing appropriation item 050620, BOE Reimbursement and Education, shall be used by the Secretary of State to reimburse county boards of elections for all eligible expenses they incur for conducting the May 6, 2025, primary and special election.
Notwithstanding section 127.19 of the Revised Code, on the effective date of this section, or as soon as possible thereafter, the Director of Budget and Management shall transfer $15,000,000 cash from the Controlling Board Emergency Purposes/Contingencies Fund (Fund 5KM0) to the BOE Reimbursement and Education Fund (Fund 5FG0).
After reimbursing county boards of elections for eligible expenses incurred in conducting the May 6, 2025, primary and special election, but not later than September 1, 2025, the Secretary of State shall certify the unexpended, unencumbered portion of this appropriation to the Director of Budget and Management. Upon receiving this certification, the Director of Budget and Management shall transfer cash equal to the certified amount from the BOE Reimbursement and Education Fund (Fund 5FG0) to the Controlling Board Emergency Purposes/Contingencies Fund (Fund 5KM0).

Notwithstanding section 127.19 of the Revised Code, on the effective date of this section, or as soon as possible thereafter, the Director of Budget and Management shall transfer $10,000,000 cash from the Controlling Board Emergency Purposes/Contingencies Fund (Fund 5KM0) to the Soil and Water Conservation District Assistance Fund (Fund 5BV0).

Section 9. Within the limits set forth in this act, the Director of Budget and Management shall establish accounts indicating the source and amount of funds for each appropriation made in this act, and shall determine the manner in which appropriation accounts shall be maintained. Expenditures from operating appropriations contained in Sections 4 through 8 of this act shall be accounted for as though made in, and are subject to all applicable provisions of, H.B. 33 of the 135th General Assembly.
Section 10. That Sections 200.30, 207.16, 207.24, 207.30, 209.10, 213.20, 221.10, 221.15, 223.10, 223.15, 237.10, 237.13, 357.05, 357.37, 371.10, 371.20, 373.10, 373.15, 379.10, 379.30, 387.10, and 387.13 of H.B. 2 of the 135th General Assembly be amended to read as follows:
Sec. 200.30. ONE TIME STRATEGIC COMMUNITY INVESTMENTS
On
the effective date of this section
June 28, 2024,
or as soon as possible thereafter, the Director of Budget and
Management shall transfer $17,800,000 cash from the General Revenue
Fund to the One Time Strategic Community Investments Fund (Fund
5AY1).
The foregoing appropriation item 042509, One Time Strategic Community Investments, shall be used by the Office of Budget and Management to provide grants for the projects listed in this section in the amounts listed. Prior to disbursing a grant to a recipient, the Office of Budget and Management shall enter into a grant agreement with the recipient. As part of the grant agreement, the recipient shall agree to complete a final report, in a form and manner to be prescribed by the Office of Budget and Management, detailing how the recipient used the grant and submit the report to the Office of Budget and Management.
An amount equal to the unexpended, unencumbered balance of the foregoing appropriation item 042509, One Time Strategic Community Investments, at the end of fiscal year 2025 is hereby reappropriated for the same purpose in fiscal year 2026.

Chapter 154. of the Revised Code, and other applicable sections of
the Revised Code, original obligations in an aggregate principal
amount not to exceed $521,000,000

obligations shall be issued, subject to applicable constitutional and
statutory limitations, as needed to provide sufficient moneys to the

ENERGY CONSERVATION PROJECT
The foregoing appropriation item C23016, Energy Conservation Project, shall be used to perform energy conservation renovations, including the United States Environmental Protection Agency's Energy Star Program, in state-owned facilities. Prior to the release of funds for renovation, state agencies shall have performed a comprehensive energy audit for each project. The Ohio Facilities Construction Commission shall review and approve proposals from state agencies to use these funds for energy conservation. Public school districts and state-supported and state-assisted institutions of higher education are not eligible for funding from this item.
STATE AGENCY PLANNING/ASSESSMENT
The foregoing appropriation item C230E5, State Agency Planning/Assessment, shall be used by the Facilities Construction Commission to provide assistance to any state agency for assessment, capital planning, and maintenance management.
STATEWIDE SITE REPAIRS
The amount reappropriated for the foregoing appropriation item C23025, Statewide Site Repairs, is the unencumbered balance as of June 30, 2024, in appropriation item C23025, Statewide Site Repairs, plus up to $35,327. Prior to the expenditure of this additional appropriation, the Facilities Construction Commission shall certify to the Director of Budget and Management canceled encumbrances up to $33,476 from appropriation item C23029, Buffington Island State Memorial, $675 from appropriation item C230DK, Zoar Bicentennial Village, and $1,176 from appropriation item C230X6, OHS-Fort Ancient Earthworks.

Prior to the expenditure of this additional appropriation, the Facilities Construction Commission shall certify to the Director of Budget and Management canceled encumbrances up to $325,747 from appropriation item C23001, Public School Buildings, $20,950,504 from appropriation item C23002, School Building Program Assistance, $80,128 from appropriation item C23005, Exceptional Needs, $209,403 from appropriation item C23010, Vocational Facilities Assistance Program, and $525,678 from appropriation item C23011, Corrective Action Grants.
Sec. 387.13. CULTURAL AND SPORTS FACILITIES PROJECTS
The amount reappropriated from the foregoing appropriation item C230FM, Cultural and Sports Facilities Projects, shall be equal to the amount of all projects specified in this section, unless the amounts are released prior to June 30, 2024.

The amount reappropriated for the foregoing appropriation item C230FM, Cultural and Sports Facilities Projects, earmarked for the Delhi Historical Society, is the unencumbered balance as of June 30, 2024, in appropriation item C58001, Community Assistance Projects, earmarked for the Lighthouse Behavioral Health Solutions Outpatient Behavioral Health Clinic.
The amount reappropriated for the foregoing appropriation item C230FM, Cultural and Sports Facilities Projects, earmarked for Paulding County Historical Electrical Wiring Project, is the unencumbered balance as of June 30, 2024, in appropriation item C725E2, Local Parks, Recreation, and Conservation Projects, earmarked for Paulding County Park District Floating Pier Addition, Paulding County Park District Boat Launch Improvement, Paulding County Park District, and Paulding County Park District Pier.

SUBSIDY APPROPRIATION
Upon approval by the Director of Budget and Management, the foregoing appropriation items shall be released to the Ohio History Connection in quarterly amounts that in total do not exceed the annual appropriations. The funds and fiscal records of the Ohio History Connection for fiscal year 2024 and fiscal year 2025 shall be examined by independent certified public accountants approved by the Auditor of State, and a copy of the audited financial statements shall be filed with the Office of Budget and Management.
The foregoing appropriations shall be considered to be the contractual consideration provided by the state to support the state's offer to contract with the Ohio History Connection under section 149.30 of the Revised Code.
HOLOCAUST AND GENOCIDE MEMORIAL AND EDUCATION COMMISSION
The foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, shall be used to support the operations of the Holocaust and Genocide Memorial and Education Commission established under section 197.03 of the Revised Code, including employment of a Director of the Office of the Commission and any other employees approved by the Commission.
Of the foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, $75,000 in each fiscal year shall be used to support scholarships to attend certificate coursework in Holocaust education offered in partnership with Yad Vashem, Ohio colleges and universities, or one of Ohio's Holocaust educational museums.
Of the foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, $150,000 in each fiscal year shall be used for recording the stories and testimonials of genocide survivors living in Ohio, as well as veterans or active duty military personnel involved in operations related to eliminating genocide.
Of the foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, $50,000 in each fiscal year shall be used for students, teachers, and community and university student leaders to attend educational programming that visits Holocaust sites. Funding may also be used by the Commission to host such programs in Europe, or at institutions approved by the Commission.
Of the foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, $175,000 in fiscal year 2024 shall be used to create curriculum related to Holocaust education that is specific to Ohio. Funding shall also be used to make curricula and catalogued artifacts available online, indexed and searchable, for use by K-12 students, teachers, librarians, home schooled students and teachers, and other staff.
Of
the foregoing appropriation item 360400, Holocaust and Genocide
Memorial and Education Commission, $175,000 in each fiscal year shall
be used for Ohio K-12 students, or other individuals approved by the
Commission, to visit one of Ohio's Holocaust education and memorial
museums. Funding may be used for transportation, admission, security,
and other related costs.,
including
those incurred by the education and memorial museums to facilitate
such visits. Funding
shall not be used for trips to the Ohio Statehouse, including visits
to the Ohio Holocaust and Liberators Memorial.
Of the foregoing appropriation item 360400, Holocaust and Genocide Memorial and Education Commission, $150,000 in each fiscal year shall be used to support the development of teacher training courses at colleges and universities related to instruction on the Holocaust as well as other approved programming by the Commission.
The Commission, in partnership with the Department of Education and Workforce and the Department of Higher Education, shall submit two reports of findings and recommendations to the general assembly and the governor not later than June 30 of each fiscal year regarding the impact of such funding, reach, and any recommended changes to the programming.
UNESCO WORLD HERITAGE SITES
The foregoing appropriation item 360402, UNESCO World Heritage Sites, shall be used for operating costs for approved United Nations Educational, Scientific and Cultural Organization (UNESCO) World Heritage sites in Ohio.
STATE HISTORICAL GRANTS
Of the foregoing appropriation item 360508, State Historical Grants, $350,000 in each fiscal year shall be used for the Western Reserve Historical Society, and $350,000 in each fiscal year shall be used for the Cincinnati Museum Center.
Of the foregoing appropriation item 360508, State Historical Grants, $250,000 in fiscal year 2024 shall be used for the Little Brown Jug to enhance the facility or increase attendance.
Of the foregoing appropriation item 360508, State Historical Grants, $200,000 in each fiscal year shall be used for the Maltz Museum of Jewish Heritage.
Of the foregoing appropriation item 360508, State Historical Grants, $70,000 in fiscal year 2024 shall be used for the Marlboro Volunteers.
Of the foregoing appropriation item 360508, State Historical Grants, $30,000 in each fiscal year shall be used for the Rootstown Historical Society.
Sec. 373.20. RECOVERY OHIO LAW ENFORCEMENT
Of the foregoing appropriation item 761403, Recovery Ohio Law Enforcement, up to $3,400,000 in each fiscal year may be used by the Office of Criminal Justice Services to support local law enforcement narcotics task forces that focus on cartel trafficking interdiction. The interdiction task forces shall be designated Ohio Organized Crime Commission task forces subject to approval and supervision of the Commission. This earmarked amount may also be used to provide funding to local law enforcement agencies, the Commission for task force-related equipment purchases, and for operating expenses of the Office of Criminal Justice Services related to the narcotics interdiction task force program.
Of the foregoing appropriation item 761403, Recovery Ohio Law Enforcement, up to $2,500,000 in each fiscal year may be used by the Office of Criminal Justice Services for Ohio's narcotics task forces in order to build new and strengthen existing partnerships with local law enforcement. This earmarked amount may also be used to provide funding to local law enforcement agencies and for operating expenses of the Office of Criminal Justice Services related to the Ohio narcotics task force program.
Of the foregoing appropriation item 761403, Recovery Ohio Law Enforcement, up to $600,000 in each fiscal year may be used to partner with the Office of Information Technology in the Department of Administrative Services to enhance and maintain a uniform records management and data intelligence system, and provide case management, collaboration, data sharing, and data analytics tools for Ohio narcotics task forces and law enforcement agencies.
OHIO NARCOTICS INTELLIGENCE CENTER
The foregoing appropriation item 761411, Ohio Narcotics Intelligence Center, may be used to operate and maintain a highly specialized Narcotics Intelligence Center consisting of personnel assigned to intelligence and computer forensic analysis that will assist Ohio narcotics task forces and law enforcement agencies.
STATE DISASTER RELIEF
Of the foregoing appropriation item 763408, State Disaster Relief, up to $1,000,000 in fiscal year 2024 shall be used to reimburse eligible response costs for emergency management and first responders in connection to the 2024 solar eclipse. The Ohio Emergency Management Agency shall develop and release guidance regarding eligibility.
LOCAL DISASTER ASSISTANCE
Of the foregoing appropriation item 763511, Local Disaster Assistance, $250,000 in fiscal year 2024 shall be distributed to the City of Columbiana for a mobile command post.
An amount equal to the unexpended, unencumbered balance of appropriation item 763511, Local Disaster Assistance, at the end of fiscal year 2023 is hereby reappropriated for the April 17, 2018, and April 8, 2019, Major Disaster Declarations for fiscal year 2024.
An amount equal to the unexpended, unencumbered balance of appropriation item 763511, Local Disaster Assistance, at the end of fiscal year 2024 is hereby reappropriated for the April 17, 2018, and April 8, 2019, Major Disaster Declarations for fiscal year 2025.
SECURITY GRANTS
(A) The foregoing appropriation item 763513, Security Grants, shall be used to make competitive grants of up to $100,000 to nonprofit organizations, houses of worship, chartered nonpublic schools, and licensed preschools for all of the following purposes:
(1) Eligible security improvements that assist the organization in preventing, preparing for, or responding to acts of terrorism;
(2) Acquiring or retaining the services of a resource officer, special duty police officer, or licensed armed security guards, including the training, licensing, or certification of resource officers;
(3) The lease or purchase of qualified equipment, including equipment for emergency and crisis communication, crisis management, or trauma and crisis response to assist in preventing, preparing for, or responding to acts of terrorism;
(4) Placing the qualified equipment at alternative locations that are off the premises belonging to the grantee, provided that the grantee receives prior permission from any appropriate county, municipal corporation, local law enforcement agency, local emergency management agency, or local transportation agency, as applicable;
(5) Funding coordinated training between law enforcement, counterterrorism agencies, and emergency responders on either the premises of a nonprofit corporation or through community-wide training efforts;
(6) Continuing coverage of costs that were authorized and paid for by a grant issued previously to the grantee in accordance with this section in previous bienniums under the program.
(B)(1) In addition to the purposes listed in division (A) of this section, a nonprofit organization that serves a broad community or geographic area may apply for and receive grants to provide antiterrorism related services for its serviced community or area, including providing armed security personnel. Prior to receiving a grant under division (B) of this section, the nonprofit organization shall provide the Emergency Management Agency with any appropriate compliance documentation. The Agency shall establish what compliance documentation is required prior to issuing grants under this division.
(2) If more than one nonprofit organization is located at the same address listed on the application, each nonprofit organization may apply for the full amount of a grant issued under this section. Each nonprofit organization shall explain in its application how it will use the grant money to address a different vulnerability than the other applicant nonprofit organizations that are located at the same address.
(C) The Emergency Management Agency shall administer and award the grants described in divisions (A) and (B) of this section. The Agency shall establish procedures and forms by which applicants may apply for a grant, a competitive process for ranking applicants and awarding the grants, and procedures for distributing grants to recipients. The procedures shall require each applicant to do all of the following:
(1) Identify and substantiate prior threats or attacks by a terrorist organization, network, or cell against the nonprofit organization, house of worship, chartered nonpublic school, or licensed preschool;
(2) Indicate the symbolic or strategic value of one or more sites that renders the site a possible target of terrorism;
(3) Discuss potential consequences to the organization if the site is damaged, destroyed, or disrupted by a terrorist;
(4) Describe how the grant will be used to integrate organizational preparedness with broader state and local preparedness efforts;
(5) Submit either a vulnerability assessment conducted by experienced security, law enforcement, or military personnel, or a credible intelligence and threat analysis from one or more qualified homeland security, counterintelligence, or anti-terrorism experts, and a description of how the grant will be used to address the vulnerabilities identified in the assessment.
The Agency shall consider all of the above factors in evaluating grant applications. The grantee shall have twenty-four months from the date of the first disbursement to meet program requirements. The Agency shall include information about the grants and the application process on its web site.
The Emergency Management Agency may prioritize a portion of funding, but not more than $1,000,000 in each fiscal year, for innovative community-public safety partnerships addressing counterterrorism prevention, provided the grantee is eligible to receive the grant as a nonprofit organization that is at risk of terror attack.
(D) Any grant submission described in division (I) of section 3313.536 of the Revised Code or section 149.433 of the Revised Code is not a public record under section 149.43 of the Revised Code and is not subject to mandatory release or disclosure under that section.
(E) The Emergency Management Agency may use up to two and one-half per cent of the total amount appropriated to administer the program, a portion of which may be used to pay costs incurred by the Department of Public Safety to provide security-related or specialized assistance in reviewing vulnerability assessments and prioritizing grant applications.
(F) As used in this section:
(1) "Eligible security improvements" means any of the following:
(a) Physical security enhancement equipment or inspection and screening equipment included on the Authorized Equipment List published by the United States Department of Homeland Security;
(b) Attendance fees and associated materials, supplies, and equipment costs for security-related training courses and programs regarding the protection of critical infrastructure and key resources, physical and cyber security, target hardening, or terrorism awareness or preparedness. Personnel and travel costs associated with training shall not be considered an eligible expense of the grant;
(c) The purchase, upgrade, or maintenance of high-speed internet for those utilizing it for security purposes.
(2) "Nonprofit organization" means a corporation, association, group, institution, society, or other organization that is exempt from federal income taxation under section 501(c)(3) of the "Internal Revenue Code of 1986," 26 U.S.C. 501(c)(3), as amended.
(3) "Resource officer" means any law enforcement officer of an accredited local law enforcement agency providing special duty services in a school setting to create or maintain a safe, secure, and orderly environment. A resource officer may include a special duty police officer, off-duty police officer, deputy sheriff, or other peace officer of the applicable local law enforcement agency in which the chartered nonpublic school or licensed preschool is located or qualifying personnel of an accredited local law enforcement agency for any jurisdiction in this state.
(4) "Terrorism" means any act taken by a group or individual used to intimidate or coerce a nonprofit organization, house of worship, chartered nonpublic school, or licensed preschool, its employees, and anyone who is or in the future may be associated with it, as well as their families; to influence the policy of the nonprofit organization, house of worship, chartered nonpublic school, or licensed preschool; and to affect the conduct of the nonprofit organization, house of worship, chartered nonpublic school, or licensed preschool.
(G) An amount equal to the unexpended, unencumbered balance of the foregoing appropriation item 763513, Security Grants, at the end of fiscal year 2023 is hereby reappropriated for the same purpose in fiscal year 2024.
(H) An amount equal to the unexpended, unencumbered balance of the foregoing appropriation item 763513, Security Grants, at the end of fiscal year 2024 is hereby reappropriated for the same purpose in fiscal year 2025.
SECURITY GRANTS PILOT PROGRAMS
(A)
Of
the foregoing appropriation item 763513, Security Grants, $197,000 in
fiscal year 2024 shall be distributed to the Jewish Federation of
Cincinnati for a mail room pilot program.
Of the foregoing appropriation item 763513, Security Grants, $150,000 in fiscal year 2024 shall be distributed to JFC Security, LLC to fund a community-focused antiterrorism cybersecurity pilot program.
Of the foregoing appropriation item 763513, Security Grants, $98,500 in fiscal year 2025 shall be distributed to the Jewish Federation of Cleveland to be used for mail room security pilot programs at the Jewish Federation of Cleveland and the Mandel Jewish Community Center.
Of the foregoing appropriation item 763513, Security Grants, $98,500 in fiscal year 2025 shall be distributed to JewishAkron for a mail room security pilot program.
Of the foregoing appropriation item 763513, Security Grants, $95,000 in fiscal year 2024 shall be distributed to the Jewish Federation of Cincinnati, to fund a community-focused antiterrorism cybersecurity pilot program.
Of the foregoing appropriation item 763513, Security Grants, $87,000 in fiscal year 2024 shall be distributed to the Mayerson Jewish Community Center Campus for a 911 Geo-Location pilot program.
(B) Funding recipients shall report to the Department of Public Safety by June 30 of each fiscal year, or as soon as possible thereafter, regarding best practices learned. Based on those reports, the Department of Public Safety shall make recommendations regarding increasing grant opportunities for the pilot program or including the pilot program as an eligible funding area within the security grants program.
JUSTICE PROGRAM SERVICES
Of the foregoing appropriation item 768425, Justice Program Services, up to $5,000,000 in each fiscal year shall be used by the Office of Criminal Justice Services to administer and distribute grants to state and local law enforcement agencies to implement or enhance body-worn camera programs.
Of the foregoing appropriation item 768425, Justice Program Services, up to $4,531,000 in fiscal year 2024 and $4,542,000 in fiscal year 2025 shall be used by the Office of Criminal Justice Services to support anti-human trafficking efforts in the areas of prosecution, victim services to specifically include assistance for child victims, and prevention and policy to implement the priorities of the Governor's Ohio Human Trafficking Task Force.
Of the foregoing appropriation item 768425, Justice Program Services, up to $4,000,000 in each fiscal year shall be used by the Office of Criminal Justice Services to administer and distribute grants to state and local law enforcement agencies to assist local communities in reducing and preventing crime through the use of promising or proven crime reduction strategies. The use of the grants includes, but is not limited to, overtime, equipment, technical assistance, and analytical support to implement crime reduction strategies.
Of the foregoing appropriation item 768425, Justice Program Services, up to $3,000,000 in each fiscal year shall be provided to the Ohio Network of Children's Advocacy Centers to administer and distribute grants to child advocacy centers to coordinate the investigation, prosecution, and treatment of child sexual abuse while helping abused children heal.
Of the foregoing appropriation item 768425, Justice Program Services, up to $1,500,000 in each fiscal year shall be used by the Office of Criminal Justice Services to competitively procure, directly from the manufacturer, a commercial off-the-shelf, completely in canal hearing protection product with a minimum noise reduction rating of 25 decibels and a maximum output of 80 decibels, to protect the hearing of law enforcement officers. The hearing protection shall be made available to any law enforcement agency in the state on a first-come, first-served basis as part of the Law Enforcement Hearing Protection Pilot Program which is hereby created.
Of the foregoing appropriation item 768425, Justice Program Services, up to $1,000,000 in each fiscal year shall be used by the Office of Criminal Justice Services to distribute grants to state and/or local law enforcement to conduct investigations on sexual assault kit testing results and related expenses.
Of the foregoing appropriation item 768425, Justice Program Services, up to $500,000 in each fiscal year shall be used by the Office of Criminal Justice Services to support state and local law enforcement agencies in the recruitment, hiring, and training of qualified individuals to serve as peace officers.
Of the foregoing appropriation item 768425, Justice Program Services, $250,000 in each fiscal year shall be distributed to the Tri-State Peer Support Team to pay the administrative costs of providing peer support and mental health services for first responders and related program development.
Of the foregoing appropriation item 768425, Justice Program Services, up to $200,000 in each fiscal year shall be used by the Office of Criminal Justice Services to implement recommendations of the Governor's Warrant Task Force.
OHIO SCHOOL SAFETY CENTER
The foregoing appropriation item 769412, Ohio School Safety Center, shall be used by the Department of Public Safety for the operations of the Ohio School Safety Center, including maintaining and promoting the Safer Ohio Schools Tip Line and assisting local schools and first responders in preventing, preparing for, and responding to threats and acts of violence, including self-harm, through a holistic, solutions-based approach to improving school safety.
Section 13. That existing Sections 221.10, 297.10, and 373.20 of H.B. 33 of the 135th General Assembly are hereby repealed.
